Mona Pinchis, King’s College London, discusses one component of her doctoral research on the historical development of the ‘fair and’ ‘equitable treatment’ (FET/ET) investment treaty clause. This presentation focuses on how the United States planned, debated and drafted the FET/ET clause within their first efforts to draft investment-focused provisions within their commercial treaties over a ten year period, from 1945 to 1955.
